1. Participation in Activities
I am participating in roller dance fitness classes, workshops, training sessions, open practice, and/or other movement, exercise, wellness, or recreational activities (collectively, the “Activities”) offered by Soul Skate, its owners, instructors, assistants, employees, or independent contractors. These Activities may take place in a physical location or may be offered online through videos, livestreams, digital platforms, or other media. All such offerings are considered Activities under this agreement.
2. Health & Physical Condition
I acknowledge that I must be in adequate physical and mental health to participate in the Activities. I understand that roller dance fitness may require significant physical exertion and may involve balance challenges, rapid movements, and the use of roller skates. I represent that I am physically fit to participate and have no medical condition that would prevent full participation. I understand it is my responsibility to consult a physician prior to participation, and if I have done so, I have followed their advice. Soul Skate reserves the right to refuse participation on medical, fitness, or other grounds.
3. Risks of Participation
I understand that participation in the Activities may result in physical injury, including but not limited to falls, collisions, sprains, strains, fractures, bruising, muscle injuries, or aggravation of pre‑existing conditions. I understand that roller skating involves inherent risks, including loss of balance, impact with other participants, or contact with the skating surface or equipment. I am responsible for monitoring my own physical condition and agree to stop or modify participation if I feel pain, discomfort, dizziness, or risk of injury.
4. Assumption of Risk
In consideration of being permitted to participate in the Activities, I agree to assume full responsibility for any and all risks, injuries, or damages, known or unknown, that I may incur as a result of participating in the Activities, including those that may result from the negligence of Soul Skate or its instructors.
5. Waiver & Release of Claims
I knowingly, voluntarily, and expressly waive any Claim (as defined below) I may have against Soul Skate, its owners, instructors, employees, assistants, and independent contractors (each a “Released Party”) arising from my participation in the Activities, even if such Claim results from the negligence of a Released Party.
I agree to indemnify and hold harmless each Released Party from any loss, liability, cost, or expense incurred in defending any Claim brought by me or on my behalf.
“Claim” includes, but is not limited to, any and all liabilities, demands, causes of action, damages, injuries, expenses, legal fees, or losses arising from participation in the Activities, including those suffered by my spouse, children, or unborn child.
6. Covenant Not to Sue
I, my heirs, and legal representatives forever release, waive, discharge, and agree not to sue any Released Party for any Claim arising from participation in the Activities.
7. Media Release
I understand that Soul Skate may photograph or record Activities and may use such images or recordings on its website, social media, or promotional materials. I consent to the use of my image or likeness for such purposes.
8. Governing Law
This agreement shall be governed by the laws of the State of Colorado. Any actions or claims relating to this agreement shall be brought in a court of competent jurisdiction located in Colorado. If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment
I acknowledge that I have carefully read this agreement, fully understand its contents, and voluntarily agree to its terms. I understand that by signing this agreement, I am giving up substantial legal rights, including the right to sue.
